Terms and Conditions

1. Scope

These General Terms and Conditions (GTC) govern all contracts, orders, deliveries, and services of Meister Messer GmbH. Deviating conditions of the customer are not recognized unless they have been expressly and in writing confirmed by Meister Messer GmbH.

2. Conclusion of Contract & Order

A purchase contract is only concluded upon dispatch of the goods. The automatic order confirmation does not constitute acceptance of the contract. Meister Messer GmbH reserves the right to reject or cancel orders without stating reasons, especially in the case of delivery bottlenecks or price changes by suppliers.

3. Availability & Stock Information

The stock information in the online shop is based on the current inventory at Meister Messer GmbH and their suppliers. This information is non-binding as stock levels can change continuously.

4. Delivery & Shipping

4.1 Delivery Area & Shipping Method

Delivery is exclusively within Switzerland.
Exclusion: Deliveries to the municipality of Samnaun (ZIP 7563) are excluded.

4.2 Delivery Times

The estimated delivery times are indicated for the respective items in the online shop. If a delivery cannot be made within the specified period, the customer will be informed of the expected delay as soon as possible.

5. Prices & Payment Terms

All prices are in Swiss Francs (CHF) and include the statutory VAT. Shipping costs are shown separately in the order process. Price adjustments are excluded after the conclusion of the contract.

6. Shipping Costs & Free Shipping

  • For shipping with the Swiss Post (A-Priority), a flat rate of CHF 9.00 is charged.
  • Free shipping for orders over CHF 100.00.
  • Additional costs for special deliveries, bulky goods, or express shipping may apply.

7. Complaints & Warranty

The customer is obliged to check the delivered goods immediately upon receipt. Defects or incorrect deliveries must be reported in writing within 30 days. Otherwise, the delivery is considered accepted.

In the case of a justified complaint, a refund of the purchase price will be made after the return of the goods. Returns must be complete and in the original packaging. Further claims for damages are excluded.

8. Right of Return

8.1 General Provisions on the Right of Return

Returns must always be reported in advance by email to help@meister-messer.ch stating the IBAN for the refund.

The return can be made with the return label included with the delivery note. If the label is lost, the goods can be returned to the following address:

8.2 Restrictions on the Right of Return

The right of return applies to a maximum of 5 units of the same item per customer. If a customer wishes to order larger quantities of a specific item, they are advised to first order a single unit to check the fit, quality, or suitability of the item.

The return of larger quantities of the same item is excluded.

8.3 Return Conditions

  • Defective on Receipt: Defective items must be reported within 30 days. The report must be made by email to help@meister-messer.ch with a detailed description of the defect. Return shipping costs will be reimbursed in this case.
  • Incorrectly Delivered: Incorrectly delivered items must be reported within 30 days. Return shipping costs will be covered.
  • Incorrectly Ordered: The customer can return items within 30 days. The original shipping costs will not be refunded, and the return shipping costs are borne by the customer.
    For orders on account: In this case, the original shipping costs will be charged retrospectively. If the invoice is not paid on time, Meister Messer GmbH reserves the right to claim the outstanding amounts by all available legal means, including collection measures.

9. Disclaimer

Meister Messer GmbH assumes no liability for:

  • Damages caused by improper use of the products,
  • indirect damages or consequential damages, especially lost profits or downtime,
  • color deviations between product images in the online shop and the actual products.

10. Data Protection & Data Sharing

Personal data is used exclusively for contract processing. Disclosure is only made to transport companies or financial service providers as far as necessary for delivery or payment.

11. Retention of Title

The goods remain the property of Meister Messer GmbH until full payment is made.

12. Weapons Law & Legal Notices

Meister Messer GmbH does not sell weapons. All offered products are not considered weapons under Swiss law and are not subject to specific legal restrictions.

13. Compensation

Claims for damages are excluded, especially in the case of:

  • Delayed or failed delivery,
  • deviations from specified delivery times,
  • non-availability of products despite stock information in the online shop,
  • operational disruptions, official measures, or force majeure.

14. Language of the GTC

The General Terms and Conditions are written in German. This version is considered legally binding. Translations are for informational purposes only and have no legal validity.

15. Applicable Law & Jurisdiction

Exclusively Swiss law applies. The place of jurisdiction is Bülach (Switzerland).

16. Final Provisions

If any provision of these GTC is invalid, the validity of the remaining provisions remains unaffected.
